Welcome to Chydee Co. These Terms of Service ("Terms") govern your access to and use of our website, products, and services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.

1. Acceptance of Terms

By using the Services, you confirm that you are at least 18 years of age, or the legal age of majority in your jurisdiction, and have the legal capacity to enter into a binding agreement. If you are using the Services on behalf of a business or entity, you represent that you have the authority to bind that entity to these Terms.

2. Account Registration

To access certain features of the Services, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password confidential and secure
  • Be responsible for all activities that occur under your account
  • Notify us immediately of any unauthorized access or use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

3. Products and Pricing

We strive to provide accurate descriptions and pricing for all products listed on the Services. However:

  • Product colors, images, and specifications may vary slightly from what is displayed
  • All prices are listed in US Dollars (USD) unless otherwise stated
  • Prices are subject to change without notice
  • We reserve the right to limit quantities or refuse orders at our discretion
  • In the event of a pricing error, we reserve the right to cancel any affected orders

4. Orders and Payment

By placing an order, you make an offer to purchase the products at the listed price. We reserve the right to accept or decline your order for any reason.

Payment Terms:

  • Payment is required at the time of purchase
  • We accept major credit cards, debit cards, PayPal, and other payment methods displayed at checkout
  • You represent that you have the legal right to use any payment method submitted
  • All transactions are processed securely through our payment processors

Order Confirmation:

  • You will receive an order confirmation email after submitting your order
  • Order confirmation does not constitute acceptance of your order
  • We reserve the right to cancel orders due to product unavailability, pricing errors, or suspected fraudulent activity

5. Shipping and Delivery

We currently ship to United States. Shipping times and costs are calculated at checkout based on your location and selected shipping method.

  • Delivery times are estimates and not guaranteed
  • We are not responsible for delays caused by shipping carriers, customs, or other circumstances beyond our control
  • Risk of loss and title for products pass to you upon delivery to the carrier
  • You are responsible for providing accurate shipping information; we are not liable for orders shipped to incorrect addresses provided by you

6. Returns and Refunds

Returns and refunds are governed by our separate Refund Policy, which is incorporated into these Terms by reference. Please review our Refund Policy for specific information about eligibility, timeframes, and procedures.

7. Product and Guide Use & Safety

The CHYDEE Weighted Sleep Mask and any accompanying CHYDEE sleep guides, reset programs, checklists, routines, or digital materials are designed to support a more intentional sleep and wind-down routine.

By purchasing, accessing, or using our products and guides, you acknowledge and agree that:

  • The CHYDEE Weighted Sleep Mask is a consumer sleep accessory, not a medical device or medical treatment.
  • CHYDEE sleep guides and digital materials are provided for general educational and informational purposes only. They are not medical advice, diagnosis, or treatment.
  • Individual sleep needs, comfort, routines, and results may vary. CHYDEE does not guarantee specific sleep, health, or wellness outcomes. 
  • Follow the product instructions and review the size and fit guide before purchasing and using the mask.
  • The current recommended fit range is approximately 22–27 inches in head circumference. Fit may vary between individuals. 
  • Adjust the strap only until the mask feels secure and comfortable. Do not overtighten the mask to increase light blocking.
  • Stop using the mask if you experience pain, excessive pressure, irritation, or significant discomfort.
  • Do not cut, puncture, alter, or intentionally damage the mask or its weighted construction.
  • If the product becomes damaged or you notice an issue with the weighted construction, discontinue use and contact support@chydeeco.com.
  • Do not rely on the mask or our guides as a substitute for professional medical advice or treatment.
  • If you have a medical condition, ongoing sleep concern, or questions about whether a particular sleep routine is appropriate for you, consult a qualified healthcare professional.
  • Use the exercises, routines, recommendations, and suggestions contained in our guides based on your own circumstances and comfort level.
  • CHYDEE is not responsible for injury, loss, or damage resulting from misuse, improper adjustment, unauthorized modification, failure to follow provided instructions, or use of the product or guides for purposes other than those intended.

The mask should not be presented as curing insomnia, anxiety, sleep apnea, or any other medical condition, and the guides should follow the same boundary.

8. Intellectual Property

All content on the Services, including but not limited to text, graphics, logos, images, product designs, and software, is the property of Chydee Co. or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Copy, reproduce, modify, or distribute our content without prior written consent
  • Use our trademarks, logos, or brand assets without permission
  • Reverse engineer, decompile, or attempt to extract source code from any software
  • Use the Services for any commercial purpose without our authorization

9. User Conduct

You agree not to use the Services to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Submit false, misleading, or fraudulent information
  • Distribute viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to our systems
  • Harass, threaten, or harm other users or our staff
  • Engage in any activity that disrupts or interferes with the Services

10. User-Generated Content

If you submit reviews, comments, or other content through the Services, you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, and display such content. You represent that:

  • You own the content or have the right to submit it
  • The content does not violate any third-party rights
  • The content is not unlawful, defamatory, or offensive

We reserve the right to remove any user-generated content at our discretion.

11. Disclaimers and Warranties

THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Services will be uninterrupted, error-free, or secure
  • Any defects will be corrected
  • The Services or servers are free of viruses or harmful components
  • The results obtained from using the Services will be accurate or reliable

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CHYDEE CO. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM:

  • Your use of or inability to use the Services
  • Any unauthorized access to or use of our servers and/or personal information
  • Any interruption or cessation of transmission to or from the Services
  • Any bugs, viruses, or similar issues transmitted through the Services

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 6 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless Chydee Co. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of any applicable laws or regulations

14. Dispute Resolution

Informal Resolution: Before filing any formal claim, you agree to first contact us at support@chydeeco.com to attempt to resolve any dispute informally.

Governing Law: These Terms are governed by the laws, without regard to its conflict of law provisions.

Jurisdiction: Any disputes arising from these Terms shall be resolved in the courts, unless required otherwise by applicable consumer protection laws in your jurisdiction.

Class Action Waiver: You agree that any disputes will be resolved on an individual basis and not as part of any class or representative action, to the extent permitted by law.

15. Termination

We may terminate or suspend your access to the Services at any time, without prior notice, for any reason, including but not limited to a breach of these Terms. Upon termination:

  • Your right to use the Services will immediately cease
  • Any provisions that by their nature should survive termination will remain in effect
  • We may delete any content or data associated with your account

16. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Services. Your continued use of the Services after changes are posted constitutes your acceptance of the modified Terms. We encourage you to review these Terms periodically.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Chydee Co. regarding your use of the Services, superseding any prior agreements.
